1. General information on data processing and the legal basis

1.1 This privacy policy describes the nature, scope and purpose of the processing of personal data within our range of services and the websites, functions and content associated with them (hereinafter collectively referred to as the “website”). This declaration applies regardless of the domains, systems, platforms and devices used (e.g. computer, tablet or smartphone).

1.2 The definitions of the terms used here, such as “personal data” or their “processing”, can be found in Art. 4 of the General Data Protection Regulation (GDPR for short).

1.3 We process users’ personal data only in compliance with the statutory data protection provisions (in particular Art. 6 para. 1 GDPR). Accordingly, data will only be processed if we have legal permission to do so; in particular if the data processing is necessary to fulfill our contractual services (e.g. processing of orders) and our online service or is required by law or if we have the consent of the user or an overriding legitimate interest on our part (e.g. interest in the analysis and optimization of our online offer).

2. Categories of data processed and legal basis for processing

2.1 As part of our offer, we process the following personal data for the performance of the contract (Art. 6 para. 1 lit. b GDPR) or on the basis of our overriding legitimate interest (Art. 6 para. 1 lit. f GDPR):

  • Inventory data (e.g. names and addresses of customers, telephone number, email address)
  • Contract data (e.g. services used, names of processors, payment information) ∙ Usage data (e.g. the websites visited on our website)
  • Content data (e.g. entries in the contact form)
  • Login and registration data (e.g. online store or events)

3. Purposes of data processing

3.1 The personal data mentioned under point 2 are processed for the following purposes:

  • Fulfillment of contractual obligations and services;
  • to respond to inquiries;
  • to prepare offers;
  • to process and fulfill orders and deliveries;
  • To make this website available and to further improve it and make it more user-friendly.

3.2 When our online services are used, we store the IP address and the time of the respective user action. The storage is based on our legitimate interests as well as those of the user in protection against misuse and other unauthorized use. This data is not passed on to third parties unless it is necessary to pursue our claims or there is a legitimate interest in doing so.

4. Transmission of data to third parties and third-party providers

4.1 Data will only be passed on within the framework of the legal requirements. We only pass on the data if this is necessary, for example, on the basis of Art. 6 para. 1 lit. b GDPR for the execution of the contract or on the basis of an overriding legitimate interest pursuant to Art. 6 para. 1 lit. f GDPR in a commercial operation.

4.2 If we use subcontractors, they are located in the EU or the EEA.

Data is not transferred to third countries. If subcontractors are used, we take appropriate legal precautions and corresponding technical and organizational measures to ensure the protection of personal data in accordance with the applicable legal provisions.

5. Security measures

5.1 We take organizational, contractual and technical security measures in accordance with the state of the art to ensure that the provisions of data protection laws are complied with and to protect the data processed by us against accidental or intentional manipulation, loss, destruction or access by unauthorized persons.

6.1 When contacting us (via contact form or email), the user’s details are processed to process the contact request and its handling in accordance with Art. 6 para. 1 lit. b GDPR.

7. Cookies & reach measurement

7.1 We use so-called cookies on our website. A cookie is a small file or other type of information storage that can be stored on your computer when you visit a website. Cookies are generally used to provide users with additional functions on a website (e.g. to make navigation easier; to find pages that you have previously viewed; to save your preferences for repeat visits). Cookies cannot access, read or modify any other data on your computer.

7.2 We use session cookies, which are only stored for the duration of your current visit to the website (e.g. to enable you to use the system at all). They are automatically deleted when you leave our website. Persistent cookies, on the other hand, remain on your computer until you delete them manually in your browser.  We use persistent cookies to recognize you the next time you visit our website.

8. Employees

8.1 We familiarize our employees who are involved in the processing of personal data (including personal customer data) with the data protection provisions of the applicable laws, give them instructions, train them and ensure that the employees have committed themselves to appropriate confidentiality or are subject to an appropriate legal obligation of confidentiality. If the customer has issued specific instructions on the processing of personal customer data, we will also inform our employees involved in the processing of personal customer data of the content of these instructions.

9. Your rights in connection with the processing of personal data

9.1.  You are entitled, among other things, (I) to check whether and which personal data we have stored about you and to receive copies of this data, (II) to request the correction, addition or deletion of your personal data that is incorrect or is not processed in accordance with the law, (III) to request us to restrict the processing, and (IV) under certain circumstances, to object to the processing of your personal data or to revoke the consent previously given for the processing, (V) to request data transfer, (VI) to find out the recipients or categories of recipients to whom your personal data is transferred, and (VII) to lodge a complaint with the competent authority (in Austria with the data protection authority).

10. Right to object

10.1 You may object to the future processing of your personal data in accordance with the statutory provisions at any time; in particular, you may object to processing for the purpose of direct marketing.

11. Deletion of data

11.1 The data stored by us will be deleted as soon as it is no longer required for its intended purpose and the deletion does not conflict with any statutory retention obligations.

11.2 According to § 132 BAO, for example, we are legally obliged to retain accounting documents (e.g. invoices, receipts) for a period of at least 7 years (longer in the event of legal disputes).

12. Amendment of the privacy policy

12.1 As the legal situation or our services, including the associated data processing, may change at any time, we reserve the right to amend this Privacy Policy accordingly. However, this only applies to declarations on data processing. If we require your consent for data processing or parts of this privacy policy contain provisions of the contractual relationship with the users, the changes will only be made with your consent.
